TERMS OF SERVICE
These terms govern your use of mypropcapital.com, the MyPropCapital trader dashboard and every evaluation or funded account you open with us. By creating an account or paying for an evaluation you accept them. If you do not agree, do not use the service. They include limits on our liability and a process for resolving disputes, so please read them in full.
1. Who we are and what we do
In these terms, "MyPropCapital", "we", "us" and "our" mean the business that operates mypropcapital.com.
MyPropCapital is a proprietary trading firm. We run trading skill evaluations and, for traders who pass, simulated funded accounts, with rewards paid by the firm from its own funds.
We are not a broker, exchange, bank, custodian, payment institution or investment adviser. We do not accept deposits for trading, do not manage money for anyone, do not hold client funds and do not give investment advice.
2. Simulated accounts, live prices
Evaluation and funded accounts are simulated accounts. Orders are filled against live Hyperliquid order-book data, including spread, slippage and funding, but no order of yours is routed to any exchange and no third-party market is affected.
Rewards on funded accounts are performance-based payments of our own funds, calculated from your simulated results. They are not investment returns, profit from your own trading capital, wages or a share in any fund, and you never own the balance shown on a simulated account.
Personal accounts, where you trade your own funds, are a separate product with their own terms and are currently closed to new deposits.
3. Eligibility
You must be at least 18 years old and legally able to enter a contract where you live.
The service is not offered to anyone resident in, located in, or a national of: Cuba, Iran, North Korea, Syria, Russia, Belarus, the Crimea, Donetsk and Luhansk regions of Ukraine; to anyone named on, or owned or controlled by someone named on, a UN, EU, UK or US sanctions list; or to anyone in a place where using it would be unlawful. It is your responsibility to check that using the service is lawful where you are.
Using a VPN, proxy, false information or another person's identity to get around these restrictions is a breach of these terms. It ends your accounts, and any reward not yet paid is forfeited.
One person, one identity. You may hold more than one account under your own identity only as our published rules allow. You may not open accounts under different identities, let anyone else trade your account, or trade anyone else's.
4. Identity checks
We may ask you to verify your identity, age, country of residence and the wallet you use, at any time and in particular before paying a reward. This may be done through a third-party verification provider.
If you do not complete a check we ask for, or it shows that you are not eligible, we may suspend your accounts and withhold rewards until it is resolved, and close them if you are not eligible.
5. Fees and payment
The evaluation fee pays for access to the evaluation, the trading terminal, market data and tools. It is not a deposit, is not held on your behalf and is not used to pay rewards: fees are kept in our Treasury for operations.
Evaluation fees are one-time. They are paid in USDT on the Arbitrum One network from the wallet linked to your account or, where card payment is offered, by card through a third-party payment provider under that provider's terms. We never see or store your full card details. The fee shown before you pay is the full amount you owe: there is no subscription, renewal or hidden charge.
You are responsible for sending the correct asset on the correct network. Funds sent on another network, or to an address other than the one our checkout uses, cannot be recovered by us.
Fees are non-refundable once the account is opened. See the Refund Policy for the narrow exceptions.
6. Trading rules
Each account is created with a rule set (profit target, daily loss limit, maximum drawdown, leverage cap and any other published limit) that is frozen onto that account and recorded on-chain. Later changes to our published rules never apply retroactively to an account already open.
Rules are enforced automatically by our risk engine on every price tick. Breaching a limit ends that account immediately. Rule changes, breaches and status changes are written to our contracts on Arbitrum.
7. Prohibited practices
The evaluation measures your own trading skill under normal market conditions. The following are not allowed.
Hedging or taking opposite positions across accounts you control, or coordinating with other traders to do so, to get around a limit. Sharing, selling, renting or transferring an account or its login. Letting someone else trade for you, or using an account manager or passing service.
Exploiting bugs, latency, stale or incorrect prices, feed errors or other features of a simulated environment that would not be available in a real market, including trades that profit only because a price was wrong.
Using software, bots or other automated tools designed to manipulate prices, spam orders or exploit the platform, or copying another trader's positions from our platform.
Using the service to launder money, finance terrorism, evade sanctions or for any other unlawful purpose, or interfering with the security or operation of the site.
If we find a prohibited practice we may close the accounts involved, cancel the trades that relied on it, withhold or refuse rewards that resulted from it and, where the law requires, report it to the authorities. Where a reward was already paid as a result of a prohibited practice, you must pay it back.
8. Funded accounts and rewards
A funded account opens automatically when you pass, under the rules you passed with. Your reward share is 80% of the simulated profit above the account's starting balance, unless your account shows a different share.
A reward is a performance reward that we pay from our company-funded Reward Reserve to a trader who passed and traded within the rules. It is not a share of any client funds and not an investment return.
You may request a reward whenever the account is in profit and flat (no open positions). You sign the request in your wallet; our Reward Reserve contract pays the USDT to the wallet the account belongs to. Rewards are subject to the Reserve's on-chain limits and to any minimum, cooldown or consistency rule shown on your account.
We may hold a reward while we complete an identity check or investigate a suspected breach of these terms, and we may refuse it if the breach is confirmed. We tell you why a reward is held.
9. Your wallet
Your account is linked to a self-custodial wallet. We never hold your private key and cannot move your funds; every payment and transfer is signed by you.
Keeping your wallet, its recovery method and your login secure is your responsibility. Blockchain transactions are irreversible, and we cannot reverse or recover a transfer you authorise.
10. Promotions, discount codes, giveaways and partners
Discount codes: one code per order, entered before you pay. A code can be limited to some plans, sizes or dates, to a number of uses, or to a first evaluation, and checkout shows the price it gives before you confirm. A creator's own code gives the same discount as our official code and credits that creator. We can end or change a code at any time; an order already placed keeps the price it was placed at. A code has no cash value and is never applied after payment.
Giveaways, the creator (UGC) programme and the affiliate programme each have their own rules, published on their pages, which apply in addition to these terms. A prize or promotional account is a simulated evaluation account and has no cash value.
Creators and affiliates are independent. They do not speak for us, and anything they say about results is their own experience, not a promise from us.
11. No advice, no fiduciary duty
Everything on the site, in the dashboard and on our channels, including market data, analysis, education and statistics, is general information only and is not investment, financial, legal or tax advice. Past results, pass rates and reward figures do not predict what you will achieve.
Every trade you place is your own decision. We do not review whether a plan or a trade is suitable for you, and we owe you no fiduciary duty.
12. Taxes
You are responsible for working out, reporting and paying any tax that applies to rewards you receive or to your use of the service. We do not give tax advice. Where the law requires it, we may report rewards to a tax authority.
13. Availability, outages and emergency actions
We aim to keep the platform running 24/7 but we do not promise uninterrupted service. Market data, price feeds, the network we settle on, wallet providers and other third-party infrastructure can fail, be delayed or give wrong values.
To protect traders and the platform we may pause trading, a market, new purchases or rewards, or close positions at the last valid price, when a price feed fails or is clearly wrong, during an outage or security incident, or when the law requires it. If a clearly wrong price caused a breach or a gain, we may correct the account to what it would have been at the correct price.
14. Changes to these terms
We may change these terms, our published rules or our pricing. We show the date of the latest version at the top of this page and, for material changes, tell account holders by email or in the dashboard before they take effect.
Changes to trading rules or reward share apply to accounts opened after the change; the rule set frozen onto an account when it opened continues to govern it. Other changes apply from the date they take effect; if you do not accept them, you can stop using the service.
15. Liability
To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us for the account the claim concerns, plus any reward already confirmed and owed to you.
We are not liable for indirect or consequential losses, lost profits or lost opportunities, or for losses caused by market conditions, price-feed or network failures, third-party services, your own trading decisions, or your loss of wallet access.
Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence, or removes rights you have as a consumer under the law of the country you live in.
16. Indemnity
If you breach these terms or the law while using the service, you agree to cover the losses, costs and reasonable legal fees that we suffer as a direct result, to the extent the law allows.
17. Ending an account
You can stop using the service at any time. We may suspend or close an account that breaches these terms, and in that case no reward is due on that account.
We may also stop offering the service, or close an account for legal or regulatory reasons. If we do that for a reason that is not your fault, we refund the fee for any evaluation that is still active and pay any reward already earned within the rules.
18. Using the content on this site
Our charts, market pages and terminal are open to any visitor without signing in. The content on them — including the charting software, the market data, the analysis tools and everything else displayed — is provided for your own personal, non-commercial use only.
You must not use any part of the content on this site for commercial purposes without first obtaining the necessary licence from us and from the relevant third-party providers. That includes redistributing, reselling, republishing, framing, scraping or otherwise extracting the charts or the market data, and building a product or service on top of them.
You must not use this site in any way that breaches any applicable law or regulation, infringes anyone's rights, or interferes with the operation or security of the site or the systems it depends on.
The charting software on our terminal is TradingView's Advanced Charts, used under licence. TradingView and its licensors own that software and the branding on it; nothing here gives you any right to it. Charts and financial information are provided by TradingView — see tradingview.com.
The MyPropCapital name, logo and site design belong to us. You may link to the site, but not in a way that suggests we endorse you or your product.
19. Complaints, disputes and governing law
If something goes wrong, email team@mypropcapital.com first. We answer within 5 business days and try to resolve every complaint within 30 days.
If a dispute cannot be resolved directly with us, it is decided by the courts that have jurisdiction under applicable law. If you are a consumer, you keep the protection of the mandatory laws of the country you live in.
To the extent the law allows, claims must be brought individually and not as part of a class or representative action.
20. General
These terms, together with the Privacy Policy, Risk Disclosure, Refund Policy, the rules shown for your account and the rules of any programme you join, are the whole agreement between you and us. In accepting them you have not relied on any promise that is not written in them.
If any part of these terms is found unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms; we may transfer ours to a company that takes over the service.
These terms are written in English. If we provide a translation, the English version applies if they differ. If you send us suggestions or feedback, we may use them without owing you anything.
